Trademark Registration
We provide Hong Kong trademark registration service for clients.
Trademark is used for promotion and to identify the goods or services of the owner of the trademark, protect the company’s reputation. After the amendments of the rules made by World Trade Organization, trademark can be any visually and graphically presented sign; it can be made by words, personal names, letters, numerals, figurative elements, or colors or any combination of these. Trademark can also include the shape of the goods (eg. diagrams, text descriptions, etc.), but the sign must be capable of being represented graphically for documentation and publication. In order to increase the chance of successful registration, clients may try to provide a self-created design with unique, creativity and meaningless wordings.
Trademark registered in the Trademark Office of The State Administration For Industry & Commerce of the People’s Republic of China and other countries does not automatically give you protection in Hong Kong. Therefore, every trademark must be registered in Hong Kong according to the Trade Mark Ordinance in order to get proper protection in Hong Kong. Clients provide the proposed trademark, the details of the goods / services to us. We will contact the clients to verify the information required. We will prepare all required documents within 2 working days. Documents will be delivered to client for signature. The signed documents should be returned to our company with the payment. We will conduct the search to confirm if the proposed trademark is available for registration. If it is available, we will commence the process of application. If it is not available, we will suggest the client to revise the trademark and conduct a search again (the search fee is borne by the client); if the client decides to discontinue the application, we will refund the fee after deducting handling charge of HK$500 and government fees paid. We will submit the required documents and fees to the Intellectual Property Department for application. A Certificate of Trademark Registration will be issued by the Intellectual Property Department within 6 months. The valid period for the registration is 10 years, which could be renewed upon expiry.
